Terms & Conditions for INtouch Platform

1. Introduction
Welcome to INtouch! These Terms & Conditions govern your use of our platform, available at https://intouch.care and https://app.intouch.care. INtouch is a digital platform that allows psychologists to publish psychological exercises, contribute to a shared library, and enable clients to engage with these exercises and maintain a mental health journal. By accessing or using our platform, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with these terms, please do not use our platform.

2. Definitions
  • "Platform" refers to the INtouch website and any related services provided through https://intouch.care and https://app.intouch.care.
  • "Psychologist" refers to a licensed mental health professional who publishes exercises on the platform.
  • "Client" refers to an individual who uses the platform to access psychological exercises and maintain a personal mental health journal.
"Content" refers to the psychological exercises, journal entries, and any other material published or shared on the platform.

3. User Eligibility
  • Psychologists must be licensed mental health professionals in their respective jurisdictions and agree to comply with all applicable laws and regulations, including data protection laws such as the General Data Protection Regulation (GDPR) and the Spanish Ley Orgánica de Protección de Datos Personales y Garantía de los Derechos Digitales (LOPDGDD).
Clients must be at least 18 years old to use the platform or must have parental consent if underage. By using the platform, you confirm that you meet this requirement.

4. Account Registration
  • Psychologists: To publish exercises on INtouch, psychologists must create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account and password.
  • Before inviting a client to the product, the psychologist must obtain the client's consent.
Clients: Clients must also create an account to access exercises and maintain a journal. You are responsible for ensuring that your account information is accurate and up-to-date.

5. Content Submission and Use
  • For Psychologists: By submitting exercises and content to the platform, you grant INtouch a non-exclusive, royalty-free, worldwide license to use, distribute, and display the content on the platform. You retain all intellectual property rights to the content you create, but you are responsible for ensuring that the content complies with all applicable laws and does not infringe on the rights of third parties.
  • For Clients: Clients may use the exercises provided by psychologists for personal development and mental health improvement. The content is for personal use only and may not be redistributed or used for commercial purposes without the explicit consent of the content creator.

  • Clients: Clients are expected to use the platform respectfully and not engage in any behavior that could harm others, including but not limited to harassment, abuse, or sharing misleading information.
8. Limitations of Liability
  • Content Accuracy: While INtouch strives to provide accurate and helpful content, we do not guarantee the accuracy, completeness, or usefulness of any information on the platform. Psychologists are responsible for the accuracy of the exercises they publish.
Liability: INtouch is not liable for any damages arising from your use of the platform, including but not limited to direct, indirect, incidental, or consequential damages. This includes any issues related to the accuracy of the content provided by psychologists.

9. Termination
  • Termination by Psychologists or Clients: You may terminate your account or your assignments at any time. Upon termination, all personal data will be handled according to our Privacy Policy.
Termination by INtouch: INtouch reserves the right to suspend or terminate any account at its discretion, especially in cases of non-compliance with these Terms & Conditions.

10. Amendments
  • INtouch may update these Terms & Conditions from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the platform following any changes constitutes your acceptance of the new terms.
11. Disclaimer
To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our websites: https://intouch.care/ ; https://app.intouch.care/ and the use of these websites. Nothing in this disclaimer will:
